Ceasing Work on a 457/TSS visa

A sponsored employee must abide by the condition on his/her visa to work only for the sponsoring employer in Australia.

If the employee ceases employment with the sponsor, he/she has three options:

  • Ensure that a new employer applies to transfer the nomination;
  • Apply for another visa; or
  • Depart Australia.

The time limit is:

  • 60 days if the visa was granted after 19 November 2016; or
  • 90 days if the visa was granted prior to this date.

A sponsored employee may be approved to work for a new employer prior to working out the notice period for the original sponsor. The Department allows the sponsored employee to serve his/her notice period with the original sponsor, even after the approval to change sponsor is granted. This is not considered a breach of visa conditions.
